Terms & Conditions


Term Times

The term will be between 10 and 12 weeks at the discretion of the Managing Director. Sessions will run on consecutive weeks during term-time and may span the holidays. Details of the Fresh Arts term times & dates can be found on our website. It is your responsibility to make yourselves aware of these.

Staff Changes 

Fresh Arts Ltd reserve the right to change teaching staff at any time.

Payment/Refunds 

The full cost of the term must be paid in full before the start of term. A child's place can be secured with either the full payment or a direct debit set up within 4 weeks of the start of term. All term booking fees however paid are non-refundable and non-transferable, as the space has been reserved for that child for the full term. The full payment is payable regardless of sessions missed or if your circumstances change. Missed sessions may not under any circumstances be added onto the end of the term. This includes after school clubs, private lesson and holiday camps.

Covid-19

Due to the global pandemic if your child has to be sent home or cannot attend our sessions due to close contact with or symptoms of the virus Covid-19, we cannot refund any payments due to us having to restrict our class sizes for the block and meet running costs.

In the unlikely event that a child or teacher in a bubble tests positive for Covid-19 and their bubble is closed we will provide replacement online classes for the duration of the closure. We will endeavour to keep the class timings the same but we cannot guarantee this. We will expect children to attend these sessions.

In the event of localised lockdowns or venue closures we will provide weekly online classes for the duration of the time that the class is closed. We will endeavour to keep class timings the same but we cannot guarantee this, we will expect children to attend these sessions.

We will not be issuing any credit notes or transfer credits unless we do not provide an online alternative, this is due to fixed running costs.

We ask all parents whose children are enrolled in any Fresh Arts sessions to read our full Covid-19 policy and fill out a parental agreement, we will not be able to admit children to classes without this.


Exclusions

In the event that we consider:

A) That you are in breach of any of these Terms and Conditions or any regulations issued from time to time by us.

B) The behaviour of your child is disruptive or likely to put other children and Fresh Arts staff in danger.

C) You behaviour towards us, other customers, children in their care or our suppliers, agents, managers, subcontractors or employees is disruptive, inappropriate, consistently negligent (including late collection of your child) or likely to bring us, or any of our products into disrepute, we reserve the right to exclude your child from any Fresh Arts activity or part thereof. In the event that your child is excluded, no fees or deposits will be repaid to you and we reserve the right to seek payment of the balance of any fees due to us.

Direct Debit Payments 

Direct Debit payments will be on the 1st of each month. If you leave within the 12 months, we will calculate if you have a small balance to pay for the current term you cancel in or if you have over paid then we will issue you a refund of the balance. Your place will automatically be reserved each term and you will be required to give us 6 week’s notice if you want to stop attending

Cancellation of Sessions 

We reserve the right to cancel any class or service at any time up to and including the date the activity starts. Should this occur we will endeavour to give you at least a days notice and will attempt to offer you a viable alternative which may be online or we will offer you a credit on your account for the value of the classes pro-rata. We do not offer a refund, credit or make up classes if classes are cancelled for reasons beyond our control including but not limited to adverse weather conditions such as snow, fires and school closures.

An exclusion to this is that due to the ongoing Covid-19 pandemic we will be offering online replacement classes for any sessions which are cancelled due to the pandemic.

Notice Period 

All PPA provision, Nursery workshops, afterschool clubs and private lessons we require one full terms notice, (APPROX 12 weeks), which will be detailed in our Service level agreement.

Private lessons are scheduled once a week during term time and outside term time at parents request. If sessions are cancelled on the day of the lesson by the parent the class will still be charged at the hourly rate + VAT. If a teacher cannot provide the lesson for any reason, in the first instance we will offer a catch up session at no extra cost, if the session cannot be made up then the following months invoice will be credited.

Health & Injuries 

We accept children on the assumption that they are in good health and it is your responsibility to alert us to any medical complaint or history suffered by your child. We do not accept liability for death or personal injury of any child attending Fresh Arts or any activity relating to Fresh Arts whether organised by Fresh Arts Ltd or otherwise save to the extent that such death or injury shall be caused by the negligence or default of any member of our staff or any other default on our part.

Publicity & Marketing

From time to time photographs, film and video recordings may be made during Fresh Arts activities for publicity, promotional or broadcast purposes. Please inform us on the signed order form if you do not want your child to appear or be identified in any such material.

General Disclaimer 

Fresh Arts Ltd reserve the right to modify, cancel or append to these Terms and Conditions and upon doing so shall provide you with notification that there has been a change. The current Terms and Conditions always appear on our website. On re-enrolment at Fresh Arts the most recent terms and conditions shall apply.

These Terms and Conditions and any documents referred to herein constitute the entire agreement between you and us in connection with your booking, purchase or use of your products and services superseding any prior agreements between you and us.
